No, apparently one needs to show intent to retain the documents to be convicted. That Biden and Pence surrendered the documents voluntarily shows that is not the case.

On the other hand, the LOTUS showed definite intent to retain the docs in his possession in his fights to avoid handing them over on request.

Biden stole classified doc's that were to be only viewed in a SCIF and never allowed to leave.....both as a senator and a VP. He had no authority whatsoever to possess SCIF level anywhere other than a SCIF facility.

He had the authority to declassify.
