OK here is the latest and greatest way the government wants to do something for your own good.

All new cars manufactured after 2026 are mandated to have alcohol detection systems.

Now is this going too far?

IMO your car is an extension of your home and the inside of that car is covered under the 4th Amendment protections.

If the government cannot mandate that your home has a breathalyzer installed that will not let you leave your house if you are drunk how can it be constitutional to place one in a car that will basically electronically perform a search of your body with zero probable cause?

Correct. An auto is private property. The requirement to search your car is a warrant, signed by a judge, showing solid probable cause.

Your car is not an extension of your home and it is illegal to drive under the influence of alcohol. Driving a car is not a protected right under the Constitution.

The government will be forcing you to pay for these when you buy a new car as well.

I'm saying the government has no right to search your person with no probable cause. Forcing a person to take a breathalyzer test ( which is a search of his body) every time he gets into a car with absolutely no probable cause is a violation of the 4th Amendment.

And I disagree with saying a car is not an extension of your home. it is your private property and either sufficient probable cause or a warrant is required for a search.

The right to travel is protected, and even a cop pulling you over has to show cause.

This is prior restraint, something unconstitutional in our country.

We are considered innocent until proven otherwise. There is an assumption of guilt that this law is intruding on.

In Canada, those who have been convicted of driving under the influence, are REQUIRED to install one of these units in their cars.

I like the idea. It will eliminate the need for police spot checks over the Christmas season, cut down on drunk driving, and save lives. Anyone who is blowing clean can drive their cars, and those who aren't, shouldn't be driving anyway.

So you have to actually be convicted of a crime first. You don't see the difference here?

Hey maybe we can have the government require that you have to be video taped while you dress to make sure no one is concealing illegal weapons too it will cut down on murder right?

Leaving your house while drunk is legal. Driving drunk is not. If the government can mandate the installation of minimal mph bumpers, safety belts, and air bag systems to improve public safety and reduce unnecessary damage, it can obviously mandate alcohol detection systems for similar purposes. Governments largely exist for this reason.

You are not being searched. You and the public are being protected from your potential negligence by manufacturer installed equipment, well worth the price where drunk driving persists. Your teenage kids go out partying on a Friday night. Suppose you wished to help prevent anyone getting killed due to their negligence while driving your car..
