there are lawyers who would jump at the chance to do this pro bono or for winning only if you really had a case.

So yea, they stole it. No different than hiring someone to do work at your house, they take your money, and don't do the work. THEY STOLE IT.

The fine print of the contract you signed to get the coverage, or your company signed, probably allows them to do this.
