I see case law clayton is still spewing his progressive bullshit,, sorry dude that was never the intent of the founders“Strict constitutionalist” is the same rightwing idiocy as “originalism”; just as failed and just as wrongheaded."AS the nation teeters at the edge of fiscal chaos, observers are reaching the conclusion that the American system of government is broken. But almost no one blames the culprit: our insistence on obedience to the Constitution, with all its archaic, idiosyncratic and downright evil provisions."
snip....
"This is not to say that we should disobey all constitutional commands. Freedom of speech and religion, equal protection of the laws and protections against governmental deprivation of life, liberty or property are important, whether or not they are in the Constitution. We should continue to follow those requirements out of respect, not obligation."
snip....
"If even this change is impossible, perhaps the dream of a country ruled by “We the people” is impossibly utopian. If so, we have to give up on the claim that we are a self-governing people who can settle our disagreements through mature and tolerant debate. But before abandoning our heritage of self-government, we ought to try extricating ourselves from constitutional bondage so that we can give real freedom a chance."
Opinion | Let’s Give Up on the Constitution
Older piece but still relevant. Don't like the rules?
Change them.
The consitution has ways "out" built in, The amendment process, either via the legislature/states or the States themselves via Article 5 Conventions.
I know how it works, I'm a strict Constitutionalist. The Left screams get rid of it every time they lose an election.
It was the original understanding and intent of the Framers that the courts determine the meaning of the Constitution – the Constitution exists solely in the context of its case law, as determined by the Supreme Court.
“But that’s not in the Constitution” is a failed and ignorant ‘argument.’
