Lawsuit: Michigan teacher tried to force Palestinian American student to stand for Pledge

West Virginia State Board of Education v. Barnette (1943): students can’t be compelled to say the Pledge of Allegiance in public school.

Barnette was about the right of US citizens who didn't want to say the pledge because of their religion, Jehovah Witnessism.

They weren't foreigners with a political beef.

Two distinct situations, Jonesie.

Leave the class then don't make political statements

You believe in forced participation. That's about as fascist as you can get.
I believe in discipline for children and she shouldn't be forced, she should leave the room or find another school... This stupid grandstanding is ridiculous and the fact that you defend it means you're part of the problem

When in Rome (And getting all the benefits of Rome) stand up you arrogant kid dipshit

What you believe doesn't ******* matter, dipshit! This issue was decided over 80 years ago. You need to catch a ******* clue!

‘A Palestinian American student in Michigan is suing a middle school teacher and Plymouth-Canton Community Schools, claiming in federal court that the educator violated the student's First Amendment right by attempting to force the student to stand for the Pledge of Allegiance. The East Middle School teacher, Carissa Soranno, according to the lawsuit, allegedly told the student, “Since you live in this country and enjoy its freedom, if you don’t like it, you should go back to your country.”

The student, 14, is referred to as D.K. in the suit and is represented in the claim in U.S. District Court in Detroit by the American Civil Liberties Union (ACLU) of Michigan and Arab American Civil Rights League. The student did not want to stand for the pledge because she believes the U.S. government has supported Israel in the Israel-Hamas war that has devastated Gaza and left thousands dead, according to the claim.

The suit, filed June 25, asks for a judgment that finds the educator's actions unconstitutional and awards damages, claiming Soranno's actions inflicted emotional distress on the student. A spokesperson for Plymouth-Canton Community Schools did not immediately respond to a request for comment from the Detroit Free Press, part of the USA TODAY Network. Soranno did not answer a voicemail left by a reporter at a phone number associated with her name.

"The right to freely speak — or not speak — is a form of protest that is fundamental to a well-functioning democracy — even when its exercise creates controversy or makes others uncomfortable," wrote Bonitsu Kitaba, interim legal director for the ACLU of Michigan, in a news release.’

hmmm, not sure about current law but in the 70's if you chose not to pledge you were free to leave the room and stand outside until it was over...in eighth grade we had two students in my class who did this...and in legalese "standing" for the pledge and "saying" it could easily be two different things.

Seems authoritarian. People want no level of authoritarianism. And the courts have decided the issue.

Except that's not what Barnette required. The Jehovah's Witlesses didn't have to leave the class.

Not really. What you are arguing is that if you are a certain group of people, you don't have rights.

Danielle Khalaf, a U.S. citizen whose family is of Palestinian descent, told the AP that she declined to stand for or recite the Pledge for three days in January in protest of U.S. support for Israel in the Jewish state’s war against Hamas in the Gaza Strip.

Khalaf, who is being represented in the lawsuit by her father, “believes that the deaths caused by the Israeli Defense Forces in Palestine were financially supported, and either implicitly or expressly supported, by the U.S. government,” according to the suit.

Carissa Sorano, the East Middle School teacher who has also been named in the ACLU lawsuit individually and in her official capacity as a teacher employed by Plymouth-Canton Community Schools, told Khalaf during class that her decision to remain seated was “disrespectful to U.S. military forces and the flag,” the lawsuit states.

Happened to me as well, back in Vietnam era.
The pledge of allegiance is illegal to mandate.
That would violated the first amendment.
This is not "meaningless" or "nonsense".
It is crucial to any republic.
happened to you as well ? are you saying you refused to stand and recite the Pledge ?

Why the kid refused to pledge is a red herring. Any mandatory pledge is invalid, like any coerced confession. Mandating a daily childhood pledge is probably less immediately harmful than a mandatory shot of untested medical products, but still creepy, and then when the kids become adults we still have the nation deeply divided, with constant shouts of fascist, traitor, America hater, etc.

My daughter was a 2nd grade teacher for 30 years. When i asked her about this she said yes we stood up every day to say it but she said kids were so busy not standing still and running about nobody really got to say it. The life of an elementary teacher. No thanks.

I'm asking why we make kids repeat this pledge they barely understand.

I always wondered why we had an "invisible" nation when I was a kid.
I wasn't talking to you ! and I'm not surprised that you don't see the value in the Pledge .. I'd bet you have no problem reciting the CCP addition oath !

Actually, look at the history of the Pledge. You'd know it was created by a socialist minister to instill the kind of obedience to the State that you "conservatives" claim you are against (but only when your guy isn't in office.)

J'Roids definition of Fascism.

You should quit while you're ahead Joey we know the Chinese communist are atheist and that they like old, ugly, lonely, miserable men like yourself. They're easy marks....if this girl was in China or Iran she'd imprisoned and tortured. Here they give her money for making a spectacle of herself...if you speak out against a Hamas Gaza you'd be tied to the back of a motorcycle and dragged through the streets.
