A mistrial for that is within the judge's call, but it would be lamest and most thin skinned reason for it, given the circumstances surrounding this case. But stranger things have been known to happen. Time will tell

What Grosskreutz meant and can easily be seen in the video, is that at first he pointed his pistol, but they raised it to the air.
The pistol was NOT at all aimed any where near to Kyle when Kyle pulled the trigger.
