Had the races been reversed it never would've gone to trial. They dropped all charges against a Black subway rider who stabbed a White mentally ill guy to death after he'd threatened his gf in another incident that same month.

I guess Penny should've waited for Neely to take a swing at someone and then he would've been free to knife him to death? No, they'd be charging him with murder.

I doubt it. The trial was constructed with the 2nd count only deliberated on if the 1st count comes back not guilty.

Now it seems that the jurors are stuck on the first count. And they can’t move on to other counts (apparently) until they reach a unanimous verdict on that first count.

Sounds like they are deadlocked on the more serious charge, which means they probably all agree on guilty for the lesser charge.

It sounds like the problem is that they aren't allowed to consider the lesser count of manslaughter unless they come to a unanimous decision on the top count.

If it's just one guy holding out, then the judge could allow them to consider the lesser count.

There is a lesser count: criminally negligent homicide.
