Nowhere did the judge declare the layoffs illegal or unconstitutional.

The fact that none of you have even attempted to make an argument as to why the layups are legal must tell you something.
The Nostra guy simply said that the Supreme Court is awesome, because he has nothing either. That was his argument. You got nothing either.
You spelled out the credo of Democrats, keep spending and don't mind the taxpayers not yet paying taxes will be forced to pay income taxes.

Whether the Prez has the Constitutional power to decline to spend money that Congress has allocated is still an open question. There is a law that prohibits it, but that law cannot trump the Constitution, and the Court has not yet ruled on the matter.
Logically, there is really no question. The Executive runs the executive departments and if he feels that the department can run properly with less money than Congress estimated, certainly he can cut back and the excess will merely go back into the treasury (or in these days, not be borrowed to cover the expense). The Prez cannot be required to, in effect, waste the taxpayers' money.
