Judge Approves Trump's 'Special Master' Request

For once we can completely agree.

Trump should have cut the classification headings off the documents, and send them to Garland, so that DOJ would know exactly what "classified" documents Trump had in his possession.

What you didn't realize is that, if DOJ knows what documents had been "declassified" by Trump, and their classification marks sent to DOJ, they could have Biden immediately "reclassify" all the documents.
Yes, Biden could do that. I've mentioned that at least once on this board already. Asking why he didn't just do that. Of course, Biden cannot then demand that Trump be prosecuted for the retroactive crime of possessing documents that Biden would later classify.

The FBI and doj screwed themselves out of that intentional theft argument, by babbling endlessly about how badly the documents were arranged how they were mixed in with non-classified documents. If the documents were so jumbled, that certainly does not show intent to keep them. It seems like a classic case of extreme carelessness.

Actually there is case law where documents that were later classified, were subject to criminal prosecution. The famous case of the college student who designed an a-bomb. His paper was confiscated by the FBI.

“We have been informed that it is being shipped back, and the National Park Service is ready to receive it, take possession of it and take custody of it,” Jim McDaniel, the National Park Service’s liaison to the White House, said Wednesday.

“The property is being returned to government custody until such time that the issues can be resolved. It may well turn out that that property is rightly the personal property of the Clintons.”

I was just thinking of that case when I posted. Yes, retroactive classification is possible, but the student was not prosecuted for possessing a design that he himself created. I don't know where you got that idea. Um, where did you get that idea?

The DOJ would never do something that absurd to anyone but Trump.

That is another example of how our government treats Clintons differently from the "common folk."

Who could possibly fault appointing a special master who can actually look at all the evidence that we are not allowed to see, and provide definitive evaluation that a judge would not be able to provide?

That is absolutely no way a highly secretive and complex legal issue like this could possibly be handled except by the appointment of a special master who will have clearance, impartiality, and technical knowledge.

To try to proceed without a special master would have been criminal.
And in fact, the search warrant already likely is criminal.
 



How could that not convince you? Bill Barr, who is trying to make his way as a professional turncoat against Trump says that he is "Skeptical?" Not "it's a lie," not "no way," but "I'm skeptical?" In the conventions of anti-Trump rhetoric, that means that he must be pretty sure that Trump did declassify them, and can prove it.
