The courts can require they make all reasonable efforts to secure his release and return to the United States.

And have the lower court judge oversee the efforts the administration is making to correct their mistake.

I'm sure if they paid El Salvador $24,000 to take a prisoner, they would accept $24,000 to release a prisoner.

so you seriously see the president calling a lower court judge and saying “judge, I asked El Salvador to release that guy and they said no.“

Then the judge says “Hmm. Playing hardball, eh? Offer 12,000 and let them bargain you up to 24,000.”

Well, let me just say that’s NOT going to happen.

The government of El Salvador is not a foreign government for Kilmar. He is El Salvadoran.

Actually it would be communication via an attorney in the justice department, reporting the efforts the administration was making. And the judge on hearing arguments from both sides, determining if those efforts were adequate or not.

In regards to being in danger if deported to El Salvador? Yes he did and the court granted withholding deportation to El Salvador.

Can you cite any cases of judges directing presidential negotiations with a foreign country?

But you have to prove he committed a crime first. You just can't go by somebody claiming he's a bad guy.

That is the admitting that in 2019 the Immigration Judge denied his asylum and that he could be deported withholding deportation to El Salvador. The Trump Administration then and now could have sent him to any other country in the world.

In open court if possible, and under seal if necessary.

Obvoiusly an error in country on the Judges part since the rest of the decision - and yes context matters when such errors are found - is about El Salvador.

Nope. no error. You should read the opinion. His family had moved to Guatemala. They were going to deport him to Guatemala. They judge found that the DOJ had not proven that conditions had improved in Guatemala to the point the judge believed he still faced persecution in Guatemala.

He would not be directing negotiations, but he would be overseeing what efforts were being made.

Such as who they are in contact with. And what reasons did El Salvador give for not releasing him.
