Is it Unfair to Arrest Illegal Aliens when they Show up for a Court Appearance or ICE Check-in?


Inside immigration courts around the country, immigrants who crossed the border illegally and were caught and released are required to appear before a judge for a preliminary hearing.

But in a new twist, the Trump administration has begun using an unexpected legal tactic in its deportation efforts. Rather than pursue a deportation case, it is convincing judges to dismiss immigrants’ cases — thus depriving the immigrants of protection from arrest and detention — then taking them into custody.

The practice, affecting immigrants released at the border and given a “notice to appear” in court under both the Trump and Biden administrations, sometimes leads to people being quickly deported by Immigration and Customs Enforcement through a process called expedited removal.


Is this a fast and effecient way of getting rid of illegal aliens, or should the Trump administration get rid of the worst of the illegals by concentrating on people who are arrested for crimes and turn out to be illegals?

Is it an issue of fairness, i.e. an illegal now trying to do it the legal way and walks into a surprise arrest? Or is an illegal an illegal, and should go to the end of the line for immigration, which is in their home country at the U.S. Consulate?
So breaking into the country is considered fair, but arresting them at court isn't :cuckoo:

As Tom Homan explained numerous times to Democrat activists pretending to be journalists: Illegal aliens who are caught committing crimes are the easiest to apprehend and deport.

Process is simple: the state or local jurisdiction notifies ICE that they have a murderer/rapist/robber/drunk driver/welfare fraudster in custody and when they are due to be released on bond, or finish their sentence. ICE comes and gets them, and processes them for removal.

Unfortunately, that isn't happening in many Dem run cities. They are protecting such criminals from ICE, so they are no easier to catch than so-called "honest" illegals.

Biden did nothing but cook the books. Did you not know that? Any illegal who crossed the border and ran back across when the CBP attempted to stop them went in the books as their being "deported". Despite the fact they later crossed anyway.
 
I can think of no more efficient way to gather illegals for deportation than from a place the government knows they will be. So can someone who opposes this please explain how it is a better use of our tax dollars to have to go out into neighborhoods to find them?

It isn't.

But when santuary judges and sanctuary city officials help criminal aliens elude ICE, then ICE has no choice but to go get them where they flee to.
 
Not exactly. What you're supposed to do to get legal status is apply for a visa and wait.

Still, I can see why you would think that.

But . . . once a person illegally enters the U.S., we have no obligation to immediately skip them to the head of the line, ahead of all the would-be immigrants applying for visas at U.S. Consulates in their own countries and then waiting for approval. We have no obligation to provide them a way to get legal status.

However . . . in a perfect world, these people who are doing what they were asked to do should be less a priority than those who are committing crimes. So why is that not happening?

Santuary cities refused to call ICE when a criminal turns out to be illegal. Judges did everything they can to stop ICE from enforcing the law, including assisting criminal defendants already in custody in escaping their lawful arresters.

As Tom Homan warned, this forced ICE to go in to communities to arrest the worst of the worst illegals, thus increasing the danger to the community instead of a safe transfer while the criminal is in custody.

Then . . . when the ICE agents take the risk to make Americans safe from criminal aliens, the mob attacks the ICE agents, and you cheer them on.

Not sure what that means. But yes, Trump is looking for numbers. The fewer illegals in the country, the fewer people killed by illegal alien drunk drivers, the fewer girls and women raped by illegal aliens, and the fewer illegal alien human traffickers forcing childrent into labor and sex-work slavery.
All this messes with the dem head counts in their blue states as far as government funding and representation....ala the census.
