Zone1 Is habeas corpus a right in a free society ?

they have to show legal residence. Garcia had no legal residence.

Wrong.
Kilmar was married, had children, and lived at the same address.
So obviously he had a legal residence, and the judge agreed when the judge issued the protection order in 2019.

Ask billy Clinton.....he didn't do no habeas corpus for illegals.....ooooops plus he deported more than Trump ....double oooops

Wrong.
What other presidents have done is offered them voluntary deportation, or a possible jail sentence over the immigration violation if they demand a hearing and lose.
All presidents have always honored habeas corpus.
The only exception were the POWs at Guantanamo, which I consider illegal.

Arbitrary? Our Constitution maintains a difference in the way citizens and illegal aliens are treated, as does yours. You can pretend everyone is equal under the law, but they're not really.

WRONG!
The Constitution clearly does require absolute identical treatment for citizens and non-citizens.
Can you rape, rob, or murder a tourist?

I didn't say diddly about US citizens being deported. That's YOUR strawman. You're dealing dishonestly.

Wrong.
Without a hearing to determine if the deportee is actually a citizen or not, then obviously citizens will be deported by clerical errors, such as 2 people with the same name.
So all people obviously always have to have the exact same due process hearings.

Then why did he ask for asylum when they were deporting him, hmmmmmmmmm

That which you love. The rise of Hitler and his disastrous 13 years.
I knew you had no idea it's you who is the fascist, that to which you accuse.

Again, I didn't say anything about them, you did.

It has actually been suspended four times.

  • Civil War (1861–1865): President Abraham Lincoln first suspended habeas corpus in Maryland in 1861 to prevent Confederate sympathizers from disrupting Union troop movements. Congress later passed the Habeas Corpus Suspension Act (1863), giving the president broader authority to suspend the writ throughout the Union for the duration of the war and in cases involving prisoners of war, spies, traitors, or military personnel. The suspension lasted until it was revoked by President Andrew Johnson in 1865

These are the only four recognized instances where the writ of habeas corpus has been formally suspended in U.S. history

Except those were all war situations, and like suspending habeas corpus even then was evil and illegal.

Again, I didn't say anything about them, you did.

Of course I said that citizens will be accidentally deported if you suspend habeas corpus.
That is the whole point of a hearing, to ensure clerical errors, like with Kilmar, do not happen.
It was illegal to send Kilmar to El Salvador prisons.

I seriously do not know why Leftists are so stupid about "due process."

It is different in every case.

When an American citizen is accused of a crime, s/he is entitled to a whole cornucopia of rights, most of the originating in the Fourth Amendment and some dating back to English Common Law.

The same cornucopia of rights does not attach to everyone in the U.S., everyone apprehended by the U.S. government, or all circumstances.

If a non-citizen is apprehended in, let's say, a raid on ...

You have the cart before the horse. Due process is how you determine if they are legal residents or not.

Apparently Pres Trump is looking to stop habeas corpus in order to speed up the deportation of people.
This is already happening and there are many examples of life changing errors happening.
The question is do you have the right to a trial ?
Does your neighbour ?
Should you have a right to counsel ?

Is it worth slowing the process down to ensure fairness ?
Illegal alien’s due process amounts to 1) are you a citizen or legal resident yes/no. If no, deport. 2) Do you have a pending asylum case? Yes/no. If no, deport. If apprehended for a crime, deport.

So as a non citizen visiting the US I can be locked up or sent to El Salvador without even being charged with a crime ?
Where is the fairness in that ?
You can be expelled and deported back to your tiny island. You can be locked up pending deportation. If your government refuses to accept you, you can be detained indefinitely. Sans a valid visa, or green card you have no legal right to be in the USA.

If You've Heard of Someone, Don't Listen to Him

It is not logical to get a legal right through illegal means. That is far more conclusive that any argument on either side. Both sides' arguments are all taken from above, and those people, pissing on us from on high, never have their listeners' interests in mind, only their own.
You are an idiot. If I am robbed while illegaly parked I still have rights.
The trump hostages are all alleged because they havent been triedlet alone convicted.
Its not complicated.

They are guilty of breaking our immigration laws I know a leftest limey shit like yourself does not care what kind of criminals come into your country. I would see every illegal deported to save just one US citizen.

Where is you fake concern for justice for people like Larisha Thompson ?
