Trump wasn't being impeached for what he did when he left office, he was being impeached for what he did as president. If it is unconstitutional, then McConnell should have simply dropped the charges, told the House it was unconstitutional, and moved on. Instead, he held a vote to impeach or acquit. And, there were 7 other Republicans who voted to impeach Trump as well.
