In the Senate they had a majority three times, 59, 51, 53, none of which make up 2/3rds. As for the states, there is no way the Democrats would get 2/3rds in the House, or the Senate. As for the states, McCain got 22 of the 50 states out there, again, when you need 2/3rds of the states and you don't have that, then what's the point?

The ACA is a very large and complex piece of legislation which made systemic changes to the healthcare system in the US, especially concerning Medicaid. I haven't delved deeply into the mechanics of it and can't comment on what's different.

I saw an interview with a Republican Senator before the 2012 election, and I'm sorry, but I don't remember who it was, but he said that these systemic changes which were being phased in, had to be stopped and the legislation repealed before 2013, otherwise, they would be impossible to undo or repeal.

This is why the 2012 Presidential election was so important to Republicans. They needed the White House to stop the ACA from being implemented. That didn't happen. Undoing the ACA won't be that easy.

If president Obama had even uttered such a thing Republicans would have gone to impeachment proceedings immediately AND RIGHTLY SO. Any president that would claim the Constitution archaic and 'bad for the country' needs to be removed from office immediately.
