The difference is how the local jurisdiction deals with the problem. West Virginia has no sanctuary policies. They cooperate with the federal government with immigration enforcement. Thus, they had no problems.

If available info says he was arrested stature weeks ago.. you probably ought to do a little research to see if he is ya know… AROUND?

In the case being discussed there was NO warrant and ICE has argued they don't need to bother.
