ICE Agents Can Now Be Arrested in Chicago

"A FEDERAL JUDGE IN CHICAGO RULED last Wednesday that starting this week ICE agents can now face arrest and contempt proceedings if they conduct unlawful, warrantless arrests, marking a dramatic shift in immigration enforcement oversight in the city.

U.S. District Judge Jeffrey Cummings found that ICE agents violated the terms of a consent decree by detaining people without proper warrants, following a surge in such arrests amid increased enforcement activity. According to the judge’s order, ICE agents must now wear body cameras and have them turned on. They also cannot arrest anyone complying with their appointment dates at immigration courthouses.

The latest order expands protections for immigrants, mandating rigorous reporting and retraining requirements for agents and creating court-backed avenues for legal consequences—including possible arrest—for those found violating the judge’s directive."

Very good.

There is no legitimate reason to object to these protections for immigrants.

ICE agents are subject to the rule of law.

I guess if the cops aren't going to arrest criminals, it makes sense for them to arrest ICE agents.

Who’s gonna arrest them??

It goes without saying that those now applauding this move by Chicago would have been screaming bloody murder about insurrection if Houston had passed a bill allowing for federal agents to be arrested when they attempted to stop border wall construction.

Evidently this goes back to an agreement ICE consented to back in 2022.
A federal judge in Chicago has imposed new limitations on the ability of Immigration and Customs Enforcement officers to make arrests without warrants, siding with plaintiffs in a long-running class-action lawsuit against ICE.

The ruling, which stems from a consent decree struck by the Biden administration in 2022, is unrelated to the pending legal challenges to President Trump’s deployment of the National Guard troops in Chicago and Portland, Ore. But it signals that another judge is skeptical about the Trump administration’s willingness to adhere to legal requirements as the president ratchets up his mass deportations.

The decision, issued on Tuesday, is confined to ICE’s Chicago area of responsibility, which includes Illinois, Indiana, Wisconsin, Missouri, Kentucky and Kansas, and will expire in February. But it could influence the courts’ interpretations of ICE’S legal authorities in similar cases elsewhere.

Oh, Biden, figures. Open the border to 10+ million, then do consent decrees to protect his illegal horde.

YOu do not need a warrant, however your need the appropriate level of probable cause. ICE can't just grab pedestrians for no reason. Again, this should not be an issue and is Constitutionally expected.
You don’t even need probable cause to detain someone

A store calls the police because a person shoplifted, the police don't go get a warrant before they come and arrest that person.

Same as with most crimes, arrests come without warrants.

We disagree but thats ok.

I think its because there was a previous consent decree between the Federales and plaintiffs.
Just because biden agreed to it does not mean trump has to

So, if I understand this, they are saying that ice agents can be arrested for doing their job?

Going to be an interesting situation if you have an ice raid in progress and local police show up to arrest them. Im sure nothing could go wrong with that......
It won't happen

Exactly! Not exactly a major hurdle.
Yep doesn’t take much to detain someone

For a court to undermine the rule of law and try to arrest officers for detaining someone without a warrant is silly. The district court can t over turn a scotus ruling like that, and given that it’s limited to just ice agents highlights it’s targeted and just an abuse of their office. Frankly grounds for impeachment
