Pretti did have a gun in his back pocket , Minnesota is a right to carry state and it was legal.2. At no time did Pretti reach for the weapon. 3. Three men had him pinned to the ground when a fourth man removed the gun from Pretti. 4. The first shot was fired on a helpless man with no weapon to defend himself.5. They kept shooting to make sure he was dead.

The Pretti shooting was unlawful use of deadly force. Given he was violent and emotionally disturbed.
