How can Obama pick this person for the Supreme Court?

I realize that it is incomprehensible to you that anyone can think for herself and come to her own conclusions on a public matter which affects her life - but some of us actually do such a thing.
The day a CON$ervative on this board actually thinks for themselves it will no longer be "incomprehensible," but I won't hold my breath.

It's pretty clear that "thinking for oneself" is a completely foreign concept to you.

She is the Solicitor General, the top legal representation in the Supreme Court.

Ya all crazy, ya heah.

Yes, she will win ratification by 71 to 29 at the best, 64 to 36 at the worst, and she will be far better than Alito and potentially as good as Roberts.

What ever you are smoking Jake you should share.

No surprise that Barry picked her, I have no problem that she has never served as a Judge, it is her Political stance that troubles me. The Constitution is the foundation of our rule of law, subject to change by amendment, not fantasy or imagination, or dreamed up usurpations. It is not a living document in any other way. By treating it such, it is disgraced. Social Justice is an oxymoron and not compatible with equal Justice or Federalism.

Amen. Not only is it disgraced, but it would torpedo ALL law written with the Constitution as it's base since it's adpotion. It would serve to put this Republic into a state of anarchy.

Any particular example?

How about the Commerce Clause dictating what one is aloud to grow in a private garden for personal use? Do you agree or not that the Federal Government exercises powers that it was not granted by the Constitution? Does that only apply when Conservatives are in power?

maybe we should consider the real possibility that it wasn't HIS choice.

You say what if? I say look behind you. Fannie and Freddie are getting another early Christmas. The man that started that circus act will probably be elected the next Governor of NY.

Why Obama is picking this new person to be on the supreme court is beyond me. Doesn't anyone see the conflict of interest of having a member of the prosecuting team be on the supreme court. Every case that is going to be argued will have a supreme court justice that has sympathies for the prosecuting team. This would not be a fair and balanced jury in any case.

I sure hope you don't fail. Your mindblowingly stupid posts keep the fear of your kind getting elected a clear and present danger. Thank you.

Uh..in answer to your question...#1 The Constitution...and secondly He can nominate ANYONE he wants.

Her background is mostly academic. She had a stint in the Clinton White House as an Associate White House Counsel (Miers parallel). Then back to academia, and something else:

From 2005 through 2008, Kagan was a member of the Research Advisory Council of the Goldman Sachs Global Markets Institute.

Elena Kagan - Wikipedia, the free encyclopedia

Wow!.

She became Solicitor General in 2009. The bulk of her career is academic. Just what we need, more ivy league entitlement oriented elitists telling the rest of us how to live.

That Goldman Sachs thing is very interesting. I'd love more G2 on that one.

Right wingers tell everyone how to live. What's "moral". Who has the "right" values. Who is going to "hell". Who is "good" and who is "evil". It's easy for them. They have a "Gawd" telling them. They don't need to rely on humanity and common sense.

So...your looking forward to Kagan being able to do all these same things I take it?

Liberals rarely cause the damage white wingers do. Roberts, Scalia, Thomas, these are dangerous men ruled by ideology.

So...Thomas is white now? Guess I'm not paying attention to the news enough. This isn't Star Wars, there are conservatives and liberals, no dark side. Both are ideologies.

USAToday claims she's gonna show Tenacity...use a strong voice....as if she's gonna run roughshod over folks that run circles around her when it comes to legal knowledge.

I suggest she STFU and listen.

Let me guess, you'd do better.

She is qualified. I don't know enough about her opinions to know if I like her per se, but there's nothing wrong with her resume.

Not many people seem to. I would have thought the left had deeper bench than this.
The far Left hates her

What is a 'good' SCJ, in your opinion?

A "good" justice is one who knows the Constitution, is not caught in the "originalist" crap propaganda, and committed to the law.

Doesn't take a public figure like Rush to see:

1. No prior experience in the job.
2. Elistist to the core.
3. Avoids statements which would reveal their true intentions.
4. Plays the male lead.
5. Will be in a job way beyond their abilities.

Look....first of all....a newbee has no business talking smack to people that have held the position for decades.

Second of all...it is her job to follow the law...not influence others to believe in your adverse beliefs.

The problem I have with anyone Obama selects is Obama....not the selection.

I don't trust his judgment. I also don't trust his motives...because he's such a snake and a liar that I really don't trust anything he does....so I don't trust this woman one bit.

He wouldn't have picked her if she wasn't like him. This political shifting of the court is a dangerous game that will have long-lasting effects....which makes who we put in the White House deadly serious even though some folks think it's a joke.

One of the things her supporters claim is that she's brilliant. Now a story is being floated that at least once she forgot to turn off her car when she got to work....she walked away from a running car and left it running all night.

Talk about having a huge Carbon-Footprint.
