The border agent screening the immigrant in detention determines if the alien meets border patrol criteria of being a possible asylum seeker. If border patrol determines, YES, then the alien is given a court date to see an immigration judge who examines the evidence presented in court, and makes the legal decision on accepting the alien as an asylee and giving them asylum, or not. The 'nots' are deported, the asylees can stay.
