The fact Chicago authorities haven't released the make/model of the gun is a pretty solid sign that the assault ban would not have stopped it. If this was an assault rifle - you can bet your ass they would have said what it was within hours

Well, based upon witness statements in the aftermath, they made it sound as though the shots were coming in very rapid succession, as fast as you can pull a trigger, which would explain all of his misses.
