Right, they simply re-stated the obvious. You can't prosecute someone over that.
You can prosecute someone over anything. There will be no conviction but Kelly and the Democrats will be exposed in the court of public opinion for trying to undermine the Commander in Chief and chain of command.

This was purely political. The Democrats wanted to get Troops questioning orders.

Go look up federal prosecution success rate. High 90s.
Then compare it to the drunken TV host's success rate.
I'm very much aware of that, and there are several reasons for it. The US criminal justice system has been corrupt for many decades. Sure, there must be a few good men, but most are like Patel and Bongino and Bondi. It's been bipartisan forever.

I'm very much aware of that, and there are several reasons for it.
Not least of which being they generally dont pursue cases that aren't solid.

Because usually they aren't putting on theater at the direction of a corrupt president.
