Fox News legal expert sees “no viable case” against James Comey

Based on what?
Based on Trump statements demonstrating selective or vindictive prosecution.

As President Donald Trump publicly pressures the Justice Department to bring criminal cases against his perceived enemies, legal experts say former FBI Director James Comey could attempt a rarely successful legal maneuver that allows judges to throw out charges that were unfairly brought.

Requests to dismiss cases based on selective or vindictive prosecutions face extremely high hurdles in court and are overwhelmingly unsuccessful. Trump himself and Hunter Biden both tried (and failed) to employ the tactic in recent years.

But after Trump publicly called on Attorney General Pam Bondi to move more aggressively in her department’s pursuit of Comey and others, the former FBI director might have the facts needed to convince a judge to throw out the
charges brought against him on Thursday.

Why do you hate our beloved grand jury system?

Why do you hate freedom?

One key aspect of a free and functioning society is to hold people accountable for their actions.

Especially people in positions of authority.

Remember that "truth to power" concept?

Why do you hate that?

Where are your “INJECT BLEACH” receipts?

You claimed you saw Trump say it, why aren’t you proving it?

So, is this an actual law, that if a president says you are guilty, you can never be found guilty?

Is it just presidents? What if like the Secretary of states says you did it?

Add more context.

When a career seasoned prosecutor says this case shouldn’t be prosecuted, and then promptly gets fired and replaced with someone who rushes it through a grand jury, the you probably have a good chance at saying it’s malicious.

See, the thing you’re missing is that Trump was directly influencing the decision to go after Comey. You don’t have that in other situations.

McCabe says he informed Comey of the leak. Comey says he didn’t

At issue is specifically Comey AUTHORIZING the leak (which btw wasn't even about Trump, but about Clinton foundation)

I’m not aware of Jim Comey ever authorizing some other person to leak information - McCabe

Biden specifically avoided any appearance of influencing prosecutions against Trump

Irony.

If ever there was an atypical case making the extremely high hurdles much easier to clear it's this one based on the orange piece of shit's public comments and the blonde sock puppet's actions.

How about we admit that BOTH political party's have pushed the truth to extremes.
Not in the best interest of America. But in the interest of advancing Their political party.

What did you expect him to do, confess?

I wonder if he'll be mocking the cost of his lawyer too?

Thats right, because you take comfort in...wait for it....lawfare.

McCabe says he informed Comey of the leak. Comey says he didn’t

He said/She said

Without proof of Comey being notified, Case fails
Is it possible that Comey directed someone other than McCabe to leak the information?

This explains why my fellow conservatives here have no answer when I ask them what James Comey lied about. Even Fox News says there’s no proof James Comey lied.

"[The indictment] seems to be premised on something that's not true, which is that [former Deputy Director Andrew] McCabe said that Comey authorized him to leak to the Wall Street Journal. If you look closely at what McCabe said, what McCabe said was that he directed a leak to The Wall Street Journal and told Comey about it after the fact," McCarthy explained.

“"So it's true that Comey never authorized it in the sense of okaying it before it happened," the legal expert expanded. "So I don't see how they can make that case."

That means nothing whatsoever. If Trump says he is guilty, he is guilty and none of his supporters will disagree with him. Evidence of guilt has now lost all meaning in the Trump administration.

The only thing that counts now is what Trump says!
