Sorry for being late to this party, but Congress has no power to meddle in Education...See Article I of the Constitution.

Even if it were a good idea for the Feds to exert controls (it isn't) the whole department is unconstitutional, and should not be funded. The reason why the Supreme Court has not made this course correction is because no Plaintiff has made a case that could be appealed up to the Court.

Perhaps some State could be required to implement a DoE policy - say on Sex Education - it would refuse, then be sanctioned by DoEd, then sue to remove the sanction (withholding of funding).

But that hasn't happened yet. Pity.
