So, what you are saying is that someone that possessing a firearm while smoking pot but not getting caught is no different than a rapist that has not been caught.

Rape is a Class A felony. A convicted rapist is a felon. A convicted rapist who is a felon, is ineligible to posses a firearm.
According to the BATF, “any person who uses or is addicted to marijuana, regardless of whether his or her State has passed legislation authorizing marijuana use for medicinal purposes, is an unlawful user of or addicted to a controlled substance, and is prohibited by Federal law from possessing firearms or ammunition.”
Lying about one's drug use when filling out a Form 4473, or possession of a controlled substance while armed, are both felony offenses.
Take it up with the BATF. I don't write the laws.
