Apple agrees to $25 million settlement with US over hiring of immigrants
Nov 9 (Reuters) - Apple Inc (AAPL.O), opens new tab will pay $25 million to settle claims by the U.S. Department of Justice that the company illegally favored immigrant workers over U.S. citizen and green card holders for certain jobs, the agency said on Thursday.

The Justice Department in a statement said Apple did not recruit U.S. citizens or permanent residents for jobs that were eligible for a federal program allowing employers to sponsor immigrant workers for green cards, in violation of a federal law that bars discrimination based on citizenship.


The settlement, opens new tab is the largest ever for the Justice Department involving claims of discrimination based on citizenship, the agency said. It requires Apple to pay $6.75 million in civil penalties and $18.25 million to an unspecified number of affected workers.



This is but one example of what corporations are doing.

Facebook settled claims that it refused to recruit or hire U.S. workers for positions it set aside for temporary visa holders, the Department of Justice announced Tuesday.

It also settled separately with the Department of Labor over potential recruitment violations through a program that makes jobs available to temporary visa holders. Under the program, companies must make good-faith efforts to recruit U.S. workers for the roles.




The DOJ settlement stems from a complaint filed under the Trump administration in December, claiming Facebook discriminated against U.S. workers by reserving certain posts for temporary visa holders from at least Jan. 1, 2018, until at least Sept. 18, 2019. The agencies said Facebook illegally and intentionally discriminated against U.S. workers based on their citizenship or immigration status while using the permanent labor certification program, or PERM.

 
India is lobbying for more H-1B visas.

However, if you go to the Dept of Labor website, search or download the database of H1B employment, specifically filtering to Trump’s various companies, what you will discover is that Trump Inc doesn’t use the H1B visa system at all. [Check for Yourself Here]

How does this reconcile? Well, having previously looked at the visa use by President Trump in his various companies {SEE HERE}, I can confidently assert (Occam’s Razor) that within the interview President Trump conflated H2B temporary worker visas, which he does use in his service industry, with H1B visas which he does not use.


 



Musk appears to be walking things back a bit. Will they really make H-1B visa holders more expensive than Americans?

If a qualified American loses a job to an illegal alien or a legal H-1B visa foreign worker because they will work for
low wages, they are both terrible situations for America.
 
Making it more expensive to hire h1 visa workers than american workers is an interesting idea. Either way wages are driven upward. We could use a major wage increase now in america

It would make for unhappy corporate admins. Interesting experiment. Would they still tell us there's not enough skilled americans?

What is interesting is that we allow Visas for international athletes and entertainers. Maybe we could do the same for the NBA.

No European NBA players or Dominican MLB players. Those jobs should go to Americans.

For real though, I know companies can pay people from India and China, for example, less than market rates. The dollar goes further in these countries.

This employment channel should be limited. I do not know how many are too many. We should definitely limit it from geopolitical adversaries like China.

No, I think that excuse would go away. Americans would quickly fill their requirements. They just enjoy low wage workers working up to 100 hours at straight time under threat of deportation. They really are 21st century indentured servants.

Its one thing if they were part of the total allowed for legal immigration. Then its foreign skilled talent permanently being added.
