Anyone setting foot in America is entitled to 'due process.' But that 'due process' can be just throwing them out. A process called 'expedited removal' is a circumstance where an illegal can be deported without a hearing under certain conditions.

If a person claims asylum and a US Citizenship and Immigration Services officer decides if the applicant is credible, that applicant can receife fuller consideration.

Under Biden, the Asylum process was abused because he let millions in and we could not process all of them. We really need to change our immigration laws because they were set up assuming we wouldn't have tens of millions hopping our border. Either that or just do what Trump is doing. Seal the border.
 
That is exactly what "Remain in Mexico" does. They get a hearing date in about 10-years and then get put back on the Mexican side of the wall.
