The way I see it is that for most of them, the charge of insurrection was too harsh. Most of them just got caught up in the moment and followed the crowd.

None of this is to say they were not guilty of something. At the very least they were all guilty of criminal trespass and similar charges. But I’ve never viewed J6 as an attempted insurrection. I don’t think that most of them, when they left the rally, had any designs on actually entering the Capital that day.

This says “at or near the Capital on J6”, not “at or near J6”.

This specifies a location (at or near the Capital) on a particular date (J6). Cole’s actions on J5 do not fall within these parameters.

Like I said, the only relation here are the dates and that is circumstantial. A competent defense lawyer could easily get that tossed.
