Apples and oranges. Criminal vs. Civil. Even Bragg knows he doesn't stand a chance of trying to retry anything regarding this case. The civil case doesn't have a snowball's chance of gaining anything for the family even if the attorney doesn't figure out that there is little chance of collecting anything. Fact of the matter is, any potential award would be eaten up by attorney's fees. Penny doesn't have anything and the majority of architects are not particularly wealthy---if he ever graduates with a degree. The civil case is a fool's errand. Penny ain't OJ.

As for a civil suit, that is unrelated to a criminal case. But to the extent that your point is that Penny has to still wade through oceans of shit, you are (sadly) very much correct.
