We will never know. If they charged him correctly in the first place he might have served some time.Bit as it was or appears the prosecutor was overzealous. Anyone who's ridden the trains knows there is a lot of crazy shit you have to put up with. Did anyone else notice the signs in the background of the city's mayor when he spoke said subway crime was down 13.5 %. I would bet this mans' action helped it go down.

I still think it's a poor consolation prize for having his life upended for doing the right thing. He just saved people from a horrible attack....just for the DA to wrongfully accuse him of Manslaughter. For restraining a thug.

Penny attacked no one else....not known for attacking innocent people. This case should have NEVER been brought. But the NY DA is known for attacking heroes....it's a NY DA thing that they have done repeatedly over the years.

Bragg didn’t do it to the black guy who did the same thing - killed a homeless lunatic threatening people on a subway car just a month after Penny. And in that case, it was worse: he stabbed the guy to death. But no trial for him, because…..you know…..black.

He probably just wants to move on with his life, but he has a case for malicious prosecution.

In the case that resembled Penny’s that happened a few weeks later, the situation was actually worse:

1) The guy in the second case stabbed to death the homeless nut threatening to kill people on the subway, whereas Penny applied force from which a normal person (not one full of drugs) would have recovered.

2) Penny remained on scene. The guy in the second case did NOT, and the cops caught him at a different station.

So….the second person applied violent force and fled the scene. The first person applied a non-lethal chokehold which he released while the vicitm was still alive, and remained on scene.

Which one gets charged and has to face 15 years in prison, possibly, and which one gets off entirely?

Hint: The guy who fled the scene and killed with violent force is the one who has charges dropped. He is black.
