Close but not correct. The three judge issued a write of Mandamus, which told Judge Sullivan that he had to immediately dismiss the case.

A writ of mandamus (Latin for "we command") is a formal court order directing a government official, public agency, or lower court to perform a specific, non-discretionary legal duty

... en banc hearing (meaning all the judges of the circuit), they said, hey you can't order it dismissed, we have to remand it back to the lower court and order the lower court to take up the motion, and they said do it quickly.

They threw out the three judge writ. And told Sullivan to get back to work on the motion to dismiss. (issued in September)

Sullivan continued to work on it for TWO MONTHS. when Trump issued Flynn a pardon (Nov 25) and two weeks later Sullivan dismissed the case (Dec 8).
Not because of the motion (still being worked on) but because of the PARDON.

Flynn and the DOJ asked for a Writ, but it was denied because it was premature, they vacated Sullivan's illegal order appointing a Gleeson, in an attempt to delay taking up the motion, and told Sullivan to take up the motion.
