In criminal law, intent is one of three general classes of mens rea necessary to constitute aconventional as opposed to strict liabilitycrime. A more formal, generally-synonymous legal term is scienter: intent or knowledge of .

Whoever, being entrusted with or having lawful possession or control of any document, writing, code book, signal book, sketch, photograph, photographic negative, blueprint, plan, map, model, instrument, appliance, note, or information, relating to the national defense, (1) through gross negligence permits the same to be removed from its proper place of custody or delivered to anyone in violation of his trust, or to be lost, stolen, abstracted, or destroyed, or (2) having knowledge that the same has been illegally removed from its proper place of custody or delivered to anyone in violation of its trust, or lost, or stolen, abstracted, or destroyed, and fails to make prompt report of such loss, theft, abstraction, or destruction to his superior officer—

Shall be fined under this title or imprisoned not more than ten years, or both.

There is not a fucking word in there about intentions.

You (and Comey) are deliberately misinterpreting "intent" here. It's as if your argument is that Hillary didn't intend for those servers to follow her home and hook themselves up in her closet to her computer and make themselves unsecured. They must have done that on their own without her knowledge.

If we apply the Comey/Duhs standard, no one can ever be prosecuted for any crime. The standard defense from this day forward should be... "I did not intend to break the law!"

So.... If you get a speeding ticket, appear in court and tell the judge you didn't intend to speed. If you get busted with marijuana, appear in court and tell the judge you never intended having drugs in your possession. If you're hauled into court for beating your wife.... you didn't intend to beat her! Driving drunk? You didn't intend to!

A new day is dawning in America!

...Oh by the way... Bush, Cheney, Rumsfeld are forever exonerated for Iraq.... never want to hear one peep out of your punk ass again about that.

18 USC 793 DOES NOT require mens rea

Whoever, being entrusted with or having lawful possession or control of any document, writing, code book, signal book, sketch, photograph, photographic negative, blueprint, plan, map, model, instrument, appliance, note, or information, relating to the national defense, (1) through gross negligence permits the same to be removed from its proper place of custody or delivered to anyone in violation of his trust

The Department of Political Justice

Thus, in the past two years, the DOJ has prosecuted a young sailor for sending a single selfie to his girlfriend that inadvertently showed a submarine sonar screen in its background. It also prosecuted a Marine lieutenant who sent his military superiors a single email about the presence of al-Qaida operatives dressed as local police in a U.S. encampment in Afghanistan — but who inadvertently used his Gmail account rather than his secure government account.

The motherfucking double standard is pure bullshit.

Since Clinton didn't transmit any actual classified information like that, what's the point of that dishonest deflection?

Yes, we are sick of your double standards, the ones you only apply to people named "Clinton". And the nation has noticed as well. Don't you think it's time you gave up on this scam? After all, it's clearly not working, and your bad behavior just pushing Clinton's poll numbers higher.

Oh... BUT,.... He didn't INTEND to do that, you see? From now on, no matter what crime you are accused of, that should be your go-to defense! You didn't INTEND to break the law! You see... DUHS and Comey have ruled on this and it's a matter of public record now. Only people who INTEND to break laws are to be prosecuted!

although I hate Petraeus the ass kisser

"And it famously prosecuted Gen. David Petraeus for sharing paper copies of his daily calendar in his guarded home with a military colleague also in the home — someone who had a secret security clearance herself — because the calendar inadvertently included secret matters in the pages underneath the calendar."

Only use words you know.
Besides you live on an island the change if any ,
will be negligible.
The only way the decision could incite violence is if some people were planning it anyway.

Of course the Teabaggers hate a mainstream Republican doing his job.

Where does this law say someone has to transfer information?

So now your loopy claim is that Clinton is a criminal for just receiving information?

You're losing it.

Maybe you're unable to read?

Nothing in there about sending or receiving. It's against the law to have classified material on your personal private server off federal property... it's proper place of custody. To have the servers moved multiple times as she did, is also a felony. There is no requirement she had to "intend" to break the law. There is no requirement that she had to "send or receive" although we know now, according to Comey, she did send and receive classified material.

She was CLEARLY in violation of this law and if she had been a Republican, you people would be screaming at the top of your lungs about it. In essence, Comey claims that "extremely careless" is somehow different than "gross negligence." This has yet to be explained.

Today, we're finding out that she flat out LIED TO CONGRESS! Under oath, she told absolute lies when questioned about her emails. This was confirmed by the FBI director today. Again... Comey seems to think that saying something that isn't true is somehow different than lying. I guess maybe he is saying she didn't INTEND to lie?

Argumentum ad ignorantum.

I just found this funny, since so many Liberals are in denial that she's lying... constantly... and some even deny that she's even under investigation. You know, since he points out her lies.

How much more time and taxpayer dollars do you want to waste on these Hillary Clinton investigations?

Republicans spent 7 million on the 8th investigation over Bengazi. Trey Gowdy, REPUBLICAN chairman of this committee is now being attacked by the Reich wing--because he didn't find any evidence of negligence or wrong doing, after spending two years on the 8th investigation. So he had to exonerate Hillary Clinton of any negligence regarding Benghazi.
With Clinton exonerated, conspiracy theorists turn on Trey Gowdy

sw1023cd_590_356.jpg

The FBI has just stated there will be no criminal charges forthcoming. They can't prove INTENT. Definition of Intent is:
the act or fact of intending : purpose; especially : the design or purpose to commit a wrongful or criminal act.
Definition of INTENT

I am certain that Colin Powell & Condi Rice will not be brought up on charges either. As they have the exact same email issues. They didn't INTEND any criminal or wrongful act either.
Rice Aides, Powell Also Got Classified Info on Personal Email Accounts

You cannot be charged with a crime without intent. If you screw something up at work, you probably did it unintentionally, and you will not be investigated or charged with a crime. It's not rocket science, it's just common sense.

Now you want to investigate the investigator because you didn't get the outcome you wanted. And you want to spend taxpayer dollars doing it, to come to the same conclusion, as was done through 8 investigations over Benghazi.

"Herein lies a lesson for Republicans who are perpetually trying to appease the far right: It’s a fool’s errand. They went to the tea party – and now they’re taking Donald Trump to the prom. Likewise, then-House Speaker John Boehner named the Benghazi committee because activists were dissatisfied that seven previous congressional investigations had failed to uncover major scandal material. Now an eighth has produced more of the same – and the agitators are as agitated as ever."

With Clinton exonerated, conspiracy theorists turn on Trey Gowdy

The more gasoline you try to throw on a dead fire, the more you risk burning down your own house. These Reich wing dog & pony shows are not working.
