Looks like Comey needs to be the target of an investigation himself. He'll probably be making some large purchases in the near future with all of his payoff money. Him and Loretta Lynch, that is. Or maybe they were just threatened.
 
Graphic is incorrect: Gross negligence is indicative of a harm that came about because of extreme carelessness, but it is not the carelessness in and of itself. If there had been a verified information leak as a result of her actions, then perhaps charges could have been filed. Leaving the door open isn't enough for a criminal charge; there has to be discernible and definite effects as a direct result of her actions. None exist in this case. As Comey said, absolutely against the rules, but criminal? No.

You're wrong. The act of sending the emails was a crime. There doesn't need to be "discernible and definite effects" as a result.

Actually, you're wrong. The emails were all sent by and to people that had the proper clearance to view them. As such, there was nothing inherently illegal about those emails, classified information or not. By the letter of the law, one of two things must be true for the person to be charged: 1) They willfully distributed or intended to distribute it to someone without proper security clearance, or 2) Through gross negligence they allow such an information breach to occur. If there was no intent to distribute and also no unauthorized recipients, then by definition under the Espionage Act of 1917 no crime was committed. As Comey himself directly said, the sending of classified materials over unapproved channels is not in an of itself a crime.

The state departments rules are what Clinton would have been disciplined under if she were still working as Secretary of State. However, those are RULES and not LAWS. Once she no longer works for them, she is beyond their reach. If she ever wanted to get a civilian job with the State Department, they could block the hell out of her, but that's really about it. Sorry, the slippery Clinton eels have evaded capture once again. They're really good at that.
