It allows Congress to set the determination aside. It was one of the first ethics rules, more than anything else.

That was an incredibly inaccurate and biased report from Fox. Colorado didn't opt to include Trump on the ballot. They stayed their decision given that it has been appealed to the SCOTUS. If SCOTUS supports Colorado or refuses to hear the case, Trump will be DROPPED FROM THE BALLOT.

They do use the Constitution to do so already. The Constitution states age limits and citizenship requirements that the states use as a criteria to determine who should be on the ballot

SOS placed Trump back on the ballot due to repo's appealing the states decision to their supreme court.

He was never removed from the ballot, the decision was stayed immediately pending either:
  • A January 4th deadline at which point the stay would be lifted, ** OR **
  • An appeal was filed with the SCOTUS before that date.
It's right there in black and white in the court document.

A state cannot determine federal laws. They cannot prosecute outside their juridiction and a federal insurrection is outside of their juridiction.
