Per a press release from Colorado Secretary of State Jena Griswold, former president Donald Trump is set to be included on the 2024 Presidential Primary Ballot in Colorado pending an appeal filed by the Colorado Republican Party.

“Set to be included” != “Removed the restored”

I showed the original source, the CSC, showing the ruling was stayed (meaning he was still on) and when and how the stay would be lifted. (Jan 4th if there was no appeal.). Since we are not to Jan 4th on the calendar, the stay was in force.

Congress can REMOVE such a legal disability.

But Section 3 does not say that only Congress may DECLARE an Insurrection at the Federal level... not even implicitly.

He was never removed from the ballot, the decision was stayed immediately pending either:
  • A January 4th deadline at which point the stay would be lifted, ** OR **
  • An appeal was filed with the SCOTUS before that date.
It's right there in black and white in the court document.

The SoS of Colorado announced she was removing Trump from the ballot. Not unanticipated since even if SCOTUS expedites the review it will barely be done by the primary.
