Maybe. But SCOTUS would have to engage in some serious legal gymnastics to come up with anything resembling legitimacy. Laws that restrict rights that are considered fundamental or that effect a group that has been historically discriminated against must be subjected to the standard of strict scrutiny . That means that the states would have to prove a compelling government interest to justify the ban on same sex marriage. They failed to do so last time around and I do not see how they could in the future. In fact, it may be more difficult since we have had gay marriage long enough now to show that there has not been any negative impact on society
