A fleeing vehicle is a deadly force. Post these alleged policies. I'll not take your word for it.


  1. Deadly force may not be used solely to prevent the escape of a fleeing suspect.
  2. Firearms may not be discharged solely to disable moving vehicles. Specifically, firearms may not be discharged at a moving vehicle unless: (1) a person in the vehicle is threatening the officer or another person with deadly force by means other than the vehicle; or (2) the vehicle is operated in a manner that threatens to cause death or serious physical injury to the officer or others, and no other objectively reasonable means of defense appear to exist, which includes moving out of the path of the vehicle. Firearms may not be discharged from a moving vehicle except in exigent circumstances. In these situations, an officer must have an articulable reason for this use of deadly force.

According to DOJ policy, a fleeing vehicle must threaten deadly force by some other means, other than by using the vehicle itself and the agent is unable to move out of the path. Neither of these conditions were meet. She didn't have a weapon and he could clearly get out of the way. Also, something else that should be noted is that it also goes against departmental policy to stand in front of a moving vehicle and claim deadly force was necessary afterwards by shooting into the car.
He wasn't standing in front of the vehicle until she turned towards him.
His bodycam video makes it quite apparent.

I have an few issues with this.

If he didn’t know what the outcome would be, then he should ******* move out of the way instead of standing in front of a car that is clearly trying to get out of there.

Additionally, he was standing maybe 1 foot to the side front of a vehicle that wasn’t moving. From that distance, I don’t think his life is in danger. Cars need room to pick up speed to kill someone.

His life wasn’t in danger. He was nudged. His response was excessive. It was unnecessary.

he had more than a reasonable belief his life was in danger and acted accordingly,,

I think he was trigger-happy and made a poor decision.
I might agree.

One poor decision on her part followed by potentially one on his part.

If she doesn't make hers, his never happens.

Nobody put her in danger.

She put him in danger.

Just how much justifies him pulling a gun...you are going to tell us.
