He actually could end up in prison. It won't be right or fair or, considering the new evidence, even constitutional. But leftist judges have proven time and again, as ultimately supported on appeal or in the Supreme Court, that the Constitution does not trump their Trump derangement syndrome.

If that were the case Judge Sullivan would have sentenced Flynn a year ago. Sullivan although a strict Judge is also a logical and even handed Judge realizing the extenuating circumstances and the foul odor of a frame up. That is why he has refused to pass sentence and allowed this evidence to be presented. Remember this all began when Judge Sullivan requested to see the 302's that just happened to go missing and now have been found showing Flynn didn't lie and was set up.
