If a visa has expired, no further due process is needed. The visa is the only permission a visitor has to be in the country. If it has expired, so has the permission.

Due process doesn't mean a court hearing. It can be whatever the law decides. In immigration matters, it's usually an interview with an immigration officer NOT a judge.

No it does not depend on "whatever the law decides".
The constitution is clear that all people have exactly the same rights, regardless of citizenship.
What is "usually" done is to cut costs, but is voluntary deportation, not forced deportation.

They have the right to request asylum.
Only if they had immediately applied for asylum upon entering the USA under our law. Under international law they don't qualify for political asylum because the USA isn't the nearest safe nation to their home.

They can't be removed through an expedited process. To deport them, they have to go through a hearing before an immigration judge.
