It looks like the Trump administration was trying to use expedited removal, which doesn’t apply to them. They’d have to go through the proceedings as dictated by 8 USC 1229 instead of 1225.

That's the loophole they are all told to use. Claim asylum, and get stuck in the waiting line.

Then you need to staff the asylum system with enough people to process the line quickly.

My wife had a very valid claim to asylum. She had been arrested in China for attending the wrong church. (Yes, my wife is a lot more religious than I am.) yet after being here for 7 years, they still hadn't scheduled a hearing for her before we switched to a relative sponsorship.

A worse case was that of a German Couple who claimed asylum because Germany doesn't allow homeschooling. It took 17 years before USCIS finally demanded they get German passports and go home.

The reason they don't is because probably 70% of them would be granted permanent residency based on our own standards of what constitutes oppression.

Courts who pretend they do are making up laws, not enforcing them.

The due process in such a case is for the family to be sent home, with as little delay as possibke.
