This guy delayed his own trial for all sorts of reasons. He wanted more discovery. He wanted time to go over the discovery. He wanted new lawyers. He wanted to represent himself. He wanted to wait on a SCOTUS decision about other defendants. He wanted to wait to see if Trump would pardon him.

It was actually the government trying to get the trial going but Lang was asking for delays.

I'm not defending any family. I'm just saying Trump should follow the law.

As for activist judges, one of the worst is Matthew Kacsmaryk. See Biden v Texas where SCOTUS decided that the president can set immigration policy, not states.

Courts who pretend they do are making up laws, not enforcing them.

Yeah, it's sad that the terrorist put his family in a position to be deported as a consequence of his crime, but he did create a situation in which prudence and concern for safety dictate that his family be sent away.

The due process in such a case is for the family to be sent home, with as little delay as possibke.

I’m sure they can be deported. The Trump administration just needs to follow the laws. Ironically, they’re probably drawing out the process by wanting to cut corners.
 
Under the Asylum Processing Rule, a person who passes a credible fear interview is considered to have applied for asylum, which means that the one-year filing deadline is automatically satisfied. They passed the credible fear interview.
