I remember this case..

He was punished for serving the Chic-Filet sandwiches.. this was during the time frame of the Gay protests of the company and there were at least one gay or gay supporting member of the band who was offended because of the choice of food and filed a complaint.

Standard rights civilians enjoy don't necessarily apply to active duty military as with a bumpersticker which could be construed as insubordination.

This manpig is just angry because President Obama's Army isn't tolerating his public bigotry (hatred of Homosexual-Americans, racism against President Obama) any more.

His lawsuit will fail. I guarantee it. Not just because I want it to, but because no court could possibly uphold the claim that, in the midst of military down-sizing, this bigot was forced out due to "muh political buhleefs" or "muh relijun".

Food can be tainted by bacteria, decay, or adulteration. Political points of view however do not taint food.

In the suit, and in an interview Thursday with Army Times, Nathan Sommers said the machinations that led to his retirement — an Article 15 that found him guilty of disobeying an order and other charges, a sub-par evaluation and a ruling by the Qualitative Management Program that ordered him out of the Army — were motivated by expressions of political and religious ideals that he said fell within Pentagon guidelines.

The Army would not comment on the lawsuit beyond a statement provided by Col. Josslyn Aberle, a spokeswoman for Military District Washington: “The soldier received due process from the military in addressing complaints [and] allowing the appeal processing for the QMP board, which determined the soldier didn’t meet the qualification for retention on active duty.”


Sounds like a trouble maker.
