He challenged it as racially based. The prosecution refuted his arguments. The judge decided the fact that the three women being educators at the high school level was more concerning than their race. It's a shame there were no white high school educators to remove, that would have pulled the teeth of the racism argument. According to Martin's girlfriend Martin WAS the aggressor. He told her he was going to "get that cracker". She testified to that in court.
It's not legal for a student to carry a knife on school grounds in Texas and Anthony either was, or had just been, suspended for carrying a knife at his home school.
