"Biden's documents are different from Trump's documents"

Haha, look at the mental gymnastics.

The docs are declassified!

No they aren't. He didn't declassify them.

Well that's just a procedural violation, then!

Pathetic.
trump wasn’t bound by a 2009 EO by obama

How does Joe Biden, or anyone for that matter maintain possession of classified material for six years? Who was in charge of maintaining accountability of these documents? If they were missing, why wasn’t there a record of who had them and their return requested?

These documents are strictly controlled. Who dropped the ball and why? Did someone on the inside know Biden had these documents and covered for him? Did someone help him gain illegal possession?

Rep Comer: we have no idea why the FBI raided Trump, but didn't raid Biden

What does it take, Garland?

But it's not that simple. If you were to steal the Mona Lisa it would still be a crime if 6 years later it was found in your garage and you then immediately gave it back even if you claimed "inadvertent mishandling." Indeed, Andy McCarthy spelled it out
That’s not a defense to a charge of mishandling classified information. It is tantamount to an admission of guilt. For conviction, federal law requires prosecutors to establish that the defendant was grossly negligent. There is no need to prove that an accused was trying to harm the United States; just that he was trusted with classified information and carelessly flouted the standards for safeguarding it.
Biden had no authority to remove these documents. He had no authority to declassify them, and he had no authority to retain them, let alone recklessly. And there is no question his handling of them was reckless.
These documents were moved around more than once. Biden's lawyers have been engaged in "rolling disclosures", i.e., the story keeps changing and it has changed once again. It's another "rolling disclosure." This time they were clearly marked "TOP SECRET." There is nothing inadvertent about this.
This demands a thorough investigation as questions remain.

Commentary:
Biden tried but failed to get garland on the SCOTUS......as a consolation prize Joey Xi gave him the AG job and we think he’s going to do the right thing?
Not bloody likely. Garland is bought and paid for.
Garland will use the Comey decision to exonerate Biden.
Remember when Comey said in 2016,
Clinton should have known better than to send classified information, Comey affirmed, adding, "I think she was extremely careless. I think she was negligent. That I could establish. What we can't establish is that she acted with the necessary criminal intent."
Please note that Presidents having classified documents was never ‘a thing’ until the media and the dark state once again demonstrated their ability to manufacturer a controversy in order to attack Trump. Previous presidents (and apparently vice presidents) given a lot of leeway to keep items for their posterity. I’ve heard Obama took a LOT of stuff from the WhiteHouse.
Now that Biden is snared in the product of their own creation, they want to try to put the cat back in the bag.

While you guys are being ridiculous I’d like to take a second to thank Biden for his problem solving . It’s been 16 hours and no new documents have been found in any garages, cars or random tables next to the toilet in that time. Dude know how to fix problems. Biden 2024!

You are right. Here is the problem, (I don't know if it is true or not)Trump sent a memo to whatever dept to claim that he declassified all classified docs that he bought when he moved out from the WH. The whatever dept and DOJ did not say a word. I guess the whole Trump era and this Biden era really made us rethink the whole democracy in the US.

Actually, the DoJ did respond and said some of those documents could not be declassified.

your link says the president is the original classifier…in fact the president at the time made that order.

it’s obivius the obama admin ignored that order when you take into account what clinton and xiden did

It also says there is a process for declassifying. It doesn't end with the president just thinking to himself they're declassified.

So he is guilty of a procedural violation? That isnt a crime. "Mishandling classified documents" is a crime, but there is no crime on the books that punishes a president for not notifying someone that he declassified material.

No one said he's guilty of a "procedural violation." :icon_rolleyes:

LOL

Of course he is -- unless another Executive Order was written after Obama's and before Trump refused to turn over classified documents.

There’s really no defined process for de-classifying information.

An Executive Order issued by Obama does not have the force of law behind it. An Obama EO only apples to his administration. EO’s are not law. A president can not create laws.

LOL

Uh, no, executive orders do not expire when the signing president leaves office. :icon_rolleyes:

It also says there is a process for declassifying. It doesn't end with the president just thinking to himself they're declassified.
it doesn’t say the president can’t do that. it doesn’t give any process for the president. in fact it’s an EO written by a president highlighting the president can make the rules

haha. of course he isn’t…but more importantly that EO doesn’t say the president can’t declassify whatever and whenever
