The DOJ knew that they could play dumb and say "we had no idea that he declassified them, so it was illegal in our eyes". That will absolutely work for them. They are perfectly insulated with that excuse. On the other hand, they know that they will never be able to charge him because all he has to do is say "I declassified those" and its over. He will NEVER be charged for those documents. NEVER.

They just did it to try to sway the midterms. Thats also why they hid the fact that Biden got busted with classified documents 6 days before the midterms.
