Trump did not have any power to declassify.
He was an ex-POTUS when he was lying to the National Archives about all of the docs already being returned.

And if you want to go back before 1/20/21 and claim Trump went through the declassification process on each and every one of these documents then fine.
Either produce the paper trail attesting to this or put Trump under oath and have him explain under penalty of perjury exactly WHICH docs he "declassified"....when....why....and (exactly) HOW?

Can you prove that he didnt in his mind declassify those documents? If you cant prove that, then there is no case. You could change the rules, maybe, but Trump wont get in trouble for it. They wont even charge him. History will prove that this post is 100% correct.

Furthermore, according to CNN, Biden had material with the SCI classification, which is higher than Top Secret. This is the order of classification from lowest to highest... Classified, Secret, Top Secret, SCI. Also, its important to point out that Hillary had HUNDREDS of documents. Way more than Trump.

2. There are 4 "tiers" of classification. Unclass for official use only (FOUO), Confidential, Secret, and Top Secret.

3. SCI is a caveat "division" within a "tier" SCI Stands for Sensitive Compartmented Information There is TS SCI, Secret SCI etc. Though I've never actually seen a Confidential SCI document there could technically be one.

Trump has never formally asserted to any authority in the government that these documents were declassified. Even if they were, there are still two problems. First problem is that they're still not his. Declassifying documents makes them available for FOIA request, which they weren't. Second problem is that he was issued a subpoena that compelled him to return the documents whether he declassified them or not. Trump had no legal authority to defy that subpoena.

I read the OP, and can poke more holes in it if needed.

A President doesn't have to "assert authority" to classify or declassify a document. The Office of the President is the authority from which all classification and declassification comes from. Everyone else's authority to classifiy or declassify anything is delegated from the President.
