You waive your HIPAA rights by authorizing release to specific individuals or the company. You obviously have never taken and employment physical recently or asked for records to be released to another doctor. When I applied for SS disability I had to list every doctor that I had seen that had records on my health condition. There were about 20. I had to sign authorizing release for all of them to allow SS to access my records.

Pleading the fifth is not a refusal to testify. Pleading the fifth is refusing to answer a particular question because by answering it truthfully, someone could put themselves in legal peril. "Were you ever told to lie about the president's health?" There are two possible answers, yes or no. If no, there's no need to plead the fifth because you don't get in trouble if you told the truth. If yes, you can get in trouble because you did. Obviously, he believes he would get in trouble if he admitted he was told to lie.

In your professional medical opinion, I'm sure it does. In the real world, very high achievers are often the types of people who are awake, alert and productive longer than the average person. They go to bed later and get up earlier than most.
