We do have a right to privacy- so the government is not allowed to tell you what kind of sex you can have in private, and can't tell you that you can't use birth control.

There is a right to free exercise of religion, and thus if you want to override that you have to show a compelling government interest, and an example of actual harm caused by such free exercise. Also you have to override it using the least restrictive method possible.
