Appeals court (surprise surprise surprise) has rejected the Trump immunity motion

Sure, let him argue he wasnā€™t really trying to get Pence to do something. I think thereā€™s ample evidence to suggest otherwise, including especially his rhetoric on January 6th and sending his mob to the capitol, but heā€™s welcome to try it.

But what this defense also means is that this wasnā€™t an official act. Trump is the chief executive. If his actions were official and within the presidential authority, he wouldnā€™t be making aspirational requests. He would be ordering.

Has the media presented any form from Trump made to Pence demanding Pence take any action? I mean in paper. What is the document.
Rhetoric was to his narrow crowd some 3 miles or so from the Capitol. Maybe it was 2 miles away. i can measure it again. Still Trump said more than you say he said. Trump told the group to be in peace. Trump told them not to commit crimes. Trump told the crowd at the Capitol to stop and go home. While you may not think that is presidential, why not?
 
Well when it gets to court lets see what Pence has to say about what he was asked to do and what he said in response.

I have not yet seen the decision. But I predicted it a while ago.

Of course this circuit court would be hell bent on denying the legal claim.

Ultimately, the SCOTUS was always the Court that was going to have to decide this one.

It is (admittedly) not a sure thing in the SCOTUS, either. Not with our hare brained Chief Justice. And the Lord alone knows how Amy will come down.

Hereā€™s the beauty of the decision. He only has one week to appeal to SCOTUS.

All of the delays to prove his innocence just came to an end. Iā€™m sure heā€™s really upset about it.

I have personally, when Biden's son was in Ukraine working for Burisma, shown video of Biden bragging he demanded Ukraine fire a prosecutor. And said prosecutor was after Biden's son. This is a crime. But there is much more. Who is the Big Guy talked about by Biden's son to get demands for enormous amounts of money be directed back to Biden? Who is on Trial now? Or soon to be put on Trial? The Big guys son?

I have no idea what you mean by a ā€œformā€ presented to Pence. This isnā€™t the DMV. There arenā€™t forms made out to steal the election. We do have the Eastman memos, contemporaneous notes by Pence and his staff and testimony from Pence and his staff.

I never mentioned anything about Trumpā€™s intent for violence. I donā€™t have to. The mere fact that he sent the tens of thousands of his supporters to the capitol (where Mike Pence was) represents an attempt to coerce.

There is (of course) an excellent chance that the SCOTUS brief and cert application are already drafted.

And who knows what SCOTUS will do with a pretrial ruling that might be better ruled upon only after a complete (trial) record is made?

If they say, ā€œwe decline cert until and unless the matter has been fully developed on a complete record,ā€ then the trial delay will possibly then end.

Depending on how long it takes SCOTUS to so rule.

Alternatively, given that any trial might be a violation of his right to Presidential immunity (assuming it exists), they may decide to address it prior to trial because what could prove to be a more efficient use of everyoneā€™s resources.

Joe was bragging about carrying out President Obama's policy of cleaning up corruption in The Ukraine. That policy was bipartisan and had international backing of the EU and the IMF. There was no crime committed. But that propaganda is old and stale......

I believe he already testified to the grand jury.
That is not where it ends. It ends in front of a Jury that the defense is also allowed to be there to defend Trump. Grand juries are designed only to persuade a trial to happen.
 
SCOTUS doesn't want to see Trump's claim on immunity. The result will be handed back to Chutkan and the trial will go forward.
