The whole event rests on one trigger-happy ICE agent who made two errors in judgment: placing himself in front of a vehicle driven by a deranged person, and then, shooting that person.

No one would expect the deranged driver to exercise judgment or restraint, but that would certainly be expected from the ICE agent. He failed at both judgment and restraint. What he did was no different than standing behind a horse that was known to kick. And even if a horse is not known to kick you don't stand behind it.
