AUSTIN, Texas (TND) — Civil rights organizations on Tuesday filed a lawsuit challenging a new Texas law that would allow authorities to arrest and detain immigrants who entered the U.S. illegally and order them to leave the country.
The lawsuit, which was filed in federal court in Austin, came less than 24 hours after Texas Gov. Greg Abbott, a Republican, signed the bill. The law is set to take effect in March.
The bill would also authorize Texas judges to order a person’s deportation without due process and before they have an opportunity to seek humanitarian protection.
The American Civil Liberties Union, the ACLU of Texas, and the Texas Civil Rights Project (TCRP) claim on behalf of El Paso County and two immigrant aid groups that the new law is unconstitutional and preempted by federal law.

Due process under the constitution prohibits the government from depriving any person of life, liberty, or property without due process of law. Deporting an illegal does not deprive him/her of life, liberty or property. It does say that the person must use the existing law to legally enter the country.

My only problem with this, if Texas enforces this law all those millions of illegals will be pouring into New Mexico as the next port of entry instead. And our 'woke' governor will let them.

I don't know. This governor is pretty 'woke' and seems to think Democrats should be able to spend money on anything they want wherever or whenever they want whether the money is in the bank or not. And she has de facto declared New Mexico a sanctuary state. It's just that the New Mexico border is significantly further north and much colder this time of year than Eagle Pass is.
